Nebraska Law Requires Coverage for Certain Pediatric Disorders

In April, Governor Pillen of Nebraska signed LB762 (“the Law”) into law, requiring insurance coverage for treatments of certain pediatric autoimmune disorders.

In addition to defining pediatric acute-onset neuropsychiatric syndrome (“PANS”) and pediatric autoimmune neuropsychiatric disorder associated with a streptococcal infection (“PANDAS”), the law requires Nebraska health insurance providers to provide treatment for PANS and PANDAS. Treatments may include, but are not limited to antibiotics, medication and behavioral therapies, plasma exchanges, and intravenous immunoglobulin.

The Law is effective for plan years beginning on or after January 1, 2027, and applies to fully insured plans written out of Nebraska and self-insured plans that are not subject to ERISA; the Law does not apply to self-insured plans that are subject to ERISA.

Employer Action

Nebraska employers with fully insured plans should work with their carriers to confirm that the applicable PANS and PANDAS treatments will be covered by their plans beginning on or after January 1, 2027.
